Kullanım Şartları
Önce şunu okuyun: WonderNap bir takip ve bilgilendirme uygulamasıdır. Tıbbi cihaz değildir; tıbbi tavsiye, teşhis veya tedavi sunmaz. Bebeğinizin sağlığına ilişkin her kararda çocuk doktorunuza danışın. Acil bir durumda derhal acil sağlık hizmetlerini arayın.
1. Şartların kabulü
Bu Kullanım Şartları ("Şartlar"), [ŞİRKET ADI] ("biz") tarafından sunulan WonderNap iOS uygulaması ve ilgili web sitesinin ("Hizmet") kullanımını düzenler. Hizmeti indirerek, bir hesap oluşturarak veya kullanarak bu Şartları kabul etmiş olursunuz. Kabul etmiyorsanız Hizmeti kullanmayın.
Kişisel verilerinizin nasıl işlendiği Gizlilik Politikası'nda açıklanmıştır ve bu Şartların ayrılmaz parçasıdır.
2. Hizmetin tanımı
WonderNap; bebeğinizin uyku ve bakım kayıtlarını tutmanıza, yaşa dayalı uyanıklık penceresi tahminleri görmenize, hatırlatıcı bildirimler almanıza, raporlar oluşturmanıza ve (ücretli katmanlarda) bu bilgileri bir eş veya bakım verenle paylaşıp gece nöbetini koordine etmenize olanak tanır.
Uyanıklık pencereleri ve gelişim dönemleri, kamuya açık genel pediatri kaynaklarına dayanan istatistiksel ortalamalardır. Her bebek farklıdır; bu değerler kişiye özel bir öneri değildir.
3. Tıbbi feragat
WonderNap bir tıbbi cihaz değildir ve herhangi bir sağlık otoritesi tarafından tıbbi amaçla onaylanmamıştır.
Hizmet aracılığıyla sunulan hiçbir içerik — uyanıklık penceresi tahminleri, gelişim dönemi bilgileri, raporlar ve AI Uyku Koçu yanıtları dâhil — tıbbi tavsiye, teşhis veya tedavi teşkil etmez ve bir sağlık profesyonelinin değerlendirmesinin yerine geçmez.
Bebeğinizin uykusu, beslenmesi, gelişimi veya sağlığıyla ilgili endişeleriniz varsa çocuk doktorunuza veya nitelikli bir sağlık profesyoneline başvurun. Hizmette okuduğunuz bir şey nedeniyle tıbbi tavsiye almayı geciktirmeyin veya göz ardı etmeyin. Acil durumlarda derhal acil sağlık hizmetlerini arayın.
Bildirimler bir güvenlik veya yaşam destek sistemi değildir. Cihazınızın kapalı olması, sessiz modda olması, izinlerin kapatılması, işletim sistemi kısıtlamaları veya teknik arızalar nedeniyle bildirimler gecikebilir veya hiç ulaşmayabilir. Bebeğinizin bakımı için yalnızca Hizmete güvenmeyin.
4. Uygunluk ve hesap
- Hizmeti kullanmak için en az 18 yaşında olmalı ve bağlayıcı bir sözleşme yapma ehliyetine sahip olmalısınız.
- Uygulamaya girdiğiniz çocuk verileri bakımından, veli veya yasal vasi sıfatıyla hareket ettiğinizi beyan edersiniz.
- Cihazınızın ve Apple Kimliğinizin güvenliğinden siz sorumlusunuz.
- Girdiğiniz bilgilerin doğruluğundan siz sorumlusunuz; yanlış doğum tarihi gibi hatalı veriler yanlış hesaplamalara yol açar.
5. Aile paylaşımı sorumluluğu
Bir aile üyesini davet ettiğinizde, bebeğinize ait profili ve kayıtları o kişiyle paylaşmış olursunuz. Kimi davet ettiğinizden ve bu kişinin veriye erişmesinin uygun olduğundan siz sorumlusunuz. Davet ettiğiniz kişilerin Hizmeti kullanım şekli veya cihazlarındaki verilerle ne yaptığı bakımından sorumluluk kabul etmiyoruz.
Paylaşımı istediğiniz zaman Uygulama içinden sonlandırabilirsiniz. Paylaşımı sonlandırmak, karşı tarafın daha önce görmüş olduğu bilgileri geri almaz.
6. Abonelikler ve ödeme
Hizmet, ücretsiz bir katman ile Premium ve Pro adlı ücretli abonelik katmanları sunar. Güncel fiyatlar fiyatlandırma bölümünde ve satın alma anında Uygulama içinde gösterilir.
- Tüm satın alımlar Apple App Store üzerinden gerçekleşir ve Apple'ın Medya ve Hizmetler Şartlarına tabidir. Ödemenizi Apple tahsil eder; kart bilgilerinizi görmeyiz.
- Abonelikler, dönem bitiminden en az 24 saat önce iptal edilmediği sürece otomatik olarak yenilenir. Yenileme ücreti, mevcut dönemin bitiminden önceki 24 saat içinde Apple Kimliğinize tahsil edilir.
- Fiyatlar bölgeye, vergilere ve döviz kurlarına göre değişebilir. Fiyat artışlarında Apple sizi bilgilendirir ve gerekli hâllerde onayınızı ister.
- Ücretli özelliklerin bir kısmı (ör. aile paylaşımı, AI Uyku Koçu) çalışması için internet bağlantısı ve geçerli bir iCloud hesabı gerektirir.
7. Ücretsiz deneme
Yıllık Premium aboneliği 7 günlük ücretsiz deneme ile sunulabilir. Deneme süresi bitmeden en az 24 saat önce iptal etmezseniz abonelik otomatik olarak ücretli döneme geçer ve ücret tahsil edilir. Ücretsiz deneme hakkı kullanıcı ve abonelik grubu başına bir kez kullanılabilir. Kullanılmayan deneme süresi, aynı içerik için bir abonelik satın aldığınızda sona erer.
8. İptal ve iade
Aboneliğinizi istediğiniz zaman iPhone'unuzda Ayarlar → Apple Kimliğiniz → Abonelikler yolundan iptal edebilirsiniz. İptal, mevcut ödeme döneminin sonunda geçerli olur; o tarihe kadar ücretli özelliklere erişiminiz devam eder.
İadeler Apple tarafından yürütülür. Uygulama üzerinden yapılan satın alımlar için doğrudan iade gerçekleştiremeyiz. İade talebinizi reportaproblem.apple.com adresinden Apple'a iletebilirsiniz. Tüketici mevzuatından doğan cayma haklarınız saklıdır.
9. AI özelliklerinin sınırları
Pro katmanındaki AI Uyku Koçu, yapay zekâ ile üretilen genel nitelikli metinler sunar. Bu yanıtlar:
- hatalı, eksik veya sizin durumunuza uygun olmayabilir;
- tıbbi tavsiye değildir ve bir uzmanın yerine geçmez;
- tıbbi, acil veya teşhise ilişkin sorularda bilinçli olarak yanıt vermez ve sizi bir sağlık profesyoneline yönlendirir.
AI yanıtlarına dayanarak aldığınız kararların sorumluluğu size aittir. Adil kullanım sağlamak için AI özelliğine makul kullanım limitleri uygulayabiliriz.
10. Kabul edilebilir kullanım
Hizmeti kullanırken şunları yapmamayı kabul edersiniz:
- Hizmete tersine mühendislik uygulamak, kaynak koda dönüştürmek veya güvenlik önlemlerini aşmaya çalışmak;
- Otomatik araçlarla aşırı istek göndermek veya altyapımıza zarar vermek;
- Hizmeti hukuka aykırı bir amaçla ya da başkalarının haklarını ihlal edecek şekilde kullanmak;
- Size ait olmayan veya paylaşma yetkiniz bulunmayan verileri Uygulamaya girmek;
- Hizmeti yeniden satmak, kiralamak veya ticari olarak yeniden dağıtmak.
11. Fikri mülkiyet
Hizmete ait yazılım, tasarım, marka, logo, illüstrasyon ve metinler [ŞİRKET ADI]'na aittir veya lisanslıdır ve ilgili mevzuatla korunur. Size, bu Şartlara uymanız koşuluyla, Hizmeti kişisel ve ticari olmayan amaçlarla kullanmanız için devredilemez ve münhasır olmayan bir lisans verilir.
Uygulamaya girdiğiniz veriler size aittir. Bu veriler üzerinde mülkiyet iddia etmeyiz; yalnızca Hizmeti size sunabilmek için gerekli olan ölçüde işleriz.
12. Garanti reddi
Hizmet, yürürlükteki mevzuatın izin verdiği azami ölçüde "olduğu gibi" ve "mevcut hâliyle" sunulur. Hizmetin kesintisiz, hatasız veya belirli bir sonucu sağlayacak şekilde çalışacağını; bildirimlerin her zaman zamanında ulaşacağını; hesaplamaların sizin bebeğiniz için doğru olacağını garanti etmiyoruz.
Tüketici mevzuatından doğan ve sözleşmeyle sınırlandırılamayan haklarınız saklıdır.
13. Sorumluluğun sınırlandırılması
Yürürlükteki mevzuatın izin verdiği azami ölçüde; dolaylı, arızi, özel veya sonuç niteliğindeki zararlardan, veri kaybından, kâr kaybından ya da Hizmete güvenmeniz nedeniyle doğan zararlardan sorumlu değiliz.
Her hâlükârda toplam sorumluluğumuz, talebin doğduğu tarihten önceki 12 ay içinde Hizmet için bize fiilen ödediğiniz tutarla sınırlıdır.
Kasıt veya ağır ihmalimizden ya da mevzuat gereği sınırlandırılamayan hâllerden doğan sorumluluğumuz bu maddeden etkilenmez.
14. Fesih
Uygulamayı cihazınızdan silerek ve aboneliğinizi iptal ederek bu sözleşmeyi istediğiniz zaman sonlandırabilirsiniz. Bu Şartları esaslı şekilde ihlal etmeniz hâlinde Hizmete erişiminizi askıya alabilir veya sonlandırabiliriz. Fesihten sonra 3, 11, 12, 13 ve 16. maddeler yürürlükte kalmaya devam eder.
15. Değişiklikler
Bu Şartları zaman zaman güncelleyebiliriz. Esaslı değişikliklerde Uygulama içinde makul bir bildirimde bulunuruz. Değişikliğin yürürlüğe girmesinden sonra Hizmeti kullanmaya devam etmeniz, güncellenmiş Şartları kabul ettiğiniz anlamına gelir.
16. Uygulanacak hukuk
Bu Şartlar Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıklarda [YETKİLİ MAHKEME] mahkemeleri ve icra daireleri yetkilidir. Tüketici sıfatıyla, bulunduğunuz yerdeki tüketici hakem heyetlerine ve tüketici mahkemelerine başvurma hakkınız saklıdır.

Read this first: WonderNap is a tracking and information app. It is not a medical device and does not provide medical advice, diagnosis or treatment. Consult your pediatrician for every decision about your baby's health. In an emergency, call emergency services immediately.
1. Acceptance of terms
These Terms of Service ("Terms") govern your use of the WonderNap iOS application and related website (the "Service"), provided by [COMPANY NAME] ("we", "us"). By downloading, creating a profile in, or using the Service you accept these Terms. If you do not agree, do not use the Service.
How we handle your personal data is described in our Privacy Policy, which forms an integral part of these Terms.
2. Description of the service
WonderNap lets you log your baby's sleep and care events, see age-based wake window estimates, receive reminder notifications, generate reports, and — on paid tiers — share this information with a partner or caregiver and coordinate the night shift.
Wake windows and developmental periods are statistical averages based on publicly available general pediatric sources. Every baby is different; these values are not individualised recommendations.
3. Medical disclaimer
WonderNap is not a medical device and has not been approved for medical purposes by any health authority.
No content provided through the Service — including wake window estimates, developmental period information, reports and AI Sleep Coach responses — constitutes medical advice, diagnosis or treatment, and none of it substitutes for assessment by a healthcare professional.
If you have concerns about your baby's sleep, feeding, development or health, consult your pediatrician or a qualified healthcare professional. Never delay or disregard medical advice because of something you read in the Service. In an emergency, call emergency services immediately.
Notifications are not a safety or life-support system. They may be delayed or fail to arrive because your device is off, in silent mode, permissions were revoked, the operating system restricts delivery, or due to technical failure. Do not rely on the Service alone for the care of your baby.
4. Eligibility and account
- You must be at least 18 years old and able to enter into a binding contract.
- You represent that you act as the parent or legal guardian of any child whose data you enter.
- You are responsible for the security of your device and your Apple Account.
- You are responsible for the accuracy of the information you enter; incorrect data such as a wrong date of birth leads to incorrect calculations.
5. Family sharing responsibility
When you invite a family member you share your baby's profile and records with that person. You are responsible for choosing whom you invite and for confirming that their access is appropriate. We accept no responsibility for how invited people use the Service or what they do with data on their devices.
You can end sharing at any time from within the App. Ending sharing does not retract information the other person has already seen.
6. Subscriptions and payment
The Service offers a free tier plus paid Premium and Pro subscription tiers. Current prices are shown in the pricing section and in the App at the point of purchase.
- All purchases are made through the Apple App Store and are subject to Apple's Media Services Terms. Apple collects your payment; we never see your card details.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. The renewal charge is billed to your Apple Account within 24 hours before the period ends.
- Prices may vary by region, taxes and exchange rates. Apple notifies you of price increases and requests your consent where required.
- Some paid features (e.g. family sharing, the AI Sleep Coach) require an internet connection and a valid iCloud account.
7. Free trial
The annual Premium subscription may be offered with a 7-day free trial. Unless you cancel at least 24 hours before the trial ends, the subscription automatically converts to a paid period and you will be charged. A free trial is available once per user and subscription group. Any unused portion of a trial ends when you purchase a subscription to the same content.
8. Cancellation and refunds
You can cancel at any time on your iPhone via Settings → your Apple Account → Subscriptions. Cancellation takes effect at the end of the current billing period; you keep access to paid features until then.
Refunds are handled by Apple. We cannot issue refunds directly for purchases made through the App. Submit refund requests to Apple at reportaproblem.apple.com. Any statutory withdrawal rights you have as a consumer are unaffected.
9. Limits of the AI features
The Pro-tier AI Sleep Coach produces general, AI-generated text. Those responses:
- may be inaccurate, incomplete or unsuited to your situation;
- are not medical advice and do not replace a professional;
- deliberately decline medical, emergency or diagnostic questions and redirect you to a healthcare professional.
You remain responsible for any decision you make based on AI responses. We may apply reasonable usage limits to the AI feature to ensure fair use.
10. Acceptable use
You agree not to:
- reverse engineer or decompile the Service, or attempt to circumvent its security measures;
- send excessive automated requests or otherwise harm our infrastructure;
- use the Service for any unlawful purpose or in a way that infringes the rights of others;
- enter data that is not yours or that you are not authorised to share;
- resell, rent or commercially redistribute the Service.
11. Intellectual property
The software, design, trade marks, logos, illustrations and text of the Service are owned by or licensed to [COMPANY NAME] and are protected by applicable law. Subject to your compliance with these Terms, you are granted a non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes.
The data you enter belongs to you. We claim no ownership over it and process it only to the extent necessary to provide the Service.
12. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted or error-free, that notifications will always arrive on time, or that calculations will be correct for your particular baby.
Your statutory consumer rights that cannot be limited by contract remain unaffected.
13. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, loss of data, loss of profit, or damages arising from your reliance on the Service.
In any event, our total liability is limited to the amount you actually paid us for the Service in the 12 months preceding the event giving rise to the claim.
Nothing in this section affects our liability for wilful misconduct or gross negligence, or any liability that cannot be limited by law.
14. Termination
You may end this agreement at any time by deleting the App and cancelling your subscription. We may suspend or terminate your access if you materially breach these Terms. Sections 3, 11, 12, 13 and 16 survive termination.
15. Changes
We may update these Terms from time to time. For material changes we will give reasonable notice inside the App. Continuing to use the Service after a change takes effect means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of [COMPETENT COURT] have jurisdiction. As a consumer, you retain the right to bring proceedings before the consumer arbitration committees and consumer courts of your place of residence.
